This Privacy Policy explains how we collect, store, and use personal information from users, whether they are Brands, Creators, or individuals interacting with our Services. For compliance with privacy and data protection laws in jurisdictions such as the United Kingdom and the European Union, NtentSignal™ is generally considered the "controller" of personal information, except where we act as a "processor" on behalf of a Brand or Creator. This means we determine how personal information is used and stored. However, our Privacy Policy does not govern how Brands, Creators, or other third parties handle personal data, as they maintain their own policies.
By using our Sites or Services—such as scanning a Controlled Logic-powered QR code, creating a Personal QR code or CLPage, or interacting with CLTags—you consent to the collection and handling of your personal information as outlined in this Privacy Policy.
The types of information we collect are detailed in the Key Privacy Details section below. This information may be provided directly by you or collected automatically through various means, including partnerships with Brands, Creators, service providers, and data partners. NtentSignal™ operates an SMS text messaging program. When you provide your mobile phone number and affirmatively opt in by checking the SMS consent checkbox on our booking page, you consent to receive recurring marketing and service text messages from NtentSignal™ at that number, including messages sent using an automatic telephone dialing system.
Consent to receive text messages is not a condition of any purchase or of submitting a booking request. Message frequency varies. Message and data rates may apply. The California Consumer Privacy Act ("CCPA") defines the "sale" of personal information in California as the exchange of user data with third parties for monetary compensation, similar to the practices of a data broker. However, the CCPA also broadens the definitions of "sale" and "sharing" to include certain standard business practices we have engaged in over the past 12 months. For instance, under the CCPA, these terms encompass the use of specific advertising services, such as when we compensate an ad tech company to install a cookie on a visitor's browser, enabling them to view advertisements for our services on other websites. In this process, the ad tech company can access the visitor’s IP address and other browser, device, or cookie-related data.
Additionally, under the CCPA, we are also considered to be "selling" personal information when we permit vendors assisting us with our services, such as analytics providers, to utilize IP addresses and browser/device/cookie data for certain improvements to their services. "Sale" and "sharing" also extend to other advertising services we employ, such as paying a third-party website to display advertisements to specific individuals by providing a list of their email addresses (or hashed versions of these addresses). This qualifies as a "sale" and "sharing" under the CCPA, even when we are the paying party. At present, we do not engage in other "sales" or "sharing" of California personal information, as defined by the CCPA, but we do disclose such information in other ways, as detailed below. We do not "sell" or "share" personal information of consumers under the age of 16 if we have actual knowledge of their age. Californians have the option to opt out of our CCPA "sales" and "sharing" by following the steps outlined in our Your Privacy Choices form.
Third-Party Vendor Use of Data. As referenced in the Standard Terms of Use, if you place an Order for Third-Party Apps, you may authorize Vendors to access or use certain data in the applicable Services. This may include transmitting, transferring, modifying, or deleting such data, or storing such data on Vendor or third-party systems. Any third-party Vendor's use of accessed data (whether data in the Services or separately collected from you or your device) is subject to the applicable Vendor Terms. NtentSignal™ Use of Data. Any data that NtentSignal™ collects from you based on your use of the App Marketplace and Apps, and your Orders is subject to the Global Privacy Statement.
Mobile Information. The sharing described in this section excludes mobile phone numbers and SMS opt-in data and consent. Mobile information is never sold, shared, or disclosed to third parties or affiliates for marketing or promotional purposes, and is disclosed only to our SMS service provider strictly to transmit the messages you requested — see SMS / Text Messaging Program above.
Through our websites and services (including NtentSignal™ and certain online properties and communications of Brands and Creators, such as via the NtentSignal™ Conversion Pixel), we and third parties automatically collect information from your device using technologies like cookies, web beacons, local storage, JavaScript, and mobile-device functionalities.
This information may include unique browser identifiers, IP addresses, browser and operating system details, device identifiers (e.g., Apple IDFA or Android Advertising ID), geolocation data, internet connection details, and insights into your usage and interactions with websites, applications, emails, and other digital properties. If you are an agent acting on behalf of a consumer, you must verify your authorization, which may involve submitting written proof that satisfies CCPA requirements, such as a signed letter from the consumer or a power of attorney. We may also require the consumer to verify their identity directly with us.
